1. Who we are
These Terms are issued by QWR Interactive Solutions Pvt. Ltd. ("QWR", "we", "us", "our"), a company incorporated in India.
Registered office: 301, 303, 304 The Golden Bell, Koregaon Park Annexe, Industrial Area, Mundhwa, Pune, Maharashtra 411036, India.
These Terms govern your use of HUMBL - the mobile app, the heyhumbl.ai website, and the browser voice demo (together, the "Service"). By creating an account, verifying your phone number, or using any part of the Service, you agree to these Terms. If you don't agree, don't use the Service.
2. Eligibility
You must be at least 18 years old (or the age of majority in your jurisdiction) to use HUMBL. By using the Service, you confirm you meet this requirement. The Service is not directed at, and we do not knowingly permit use by, anyone under 18.
This bar is set deliberately above every child-specific data-protection threshold in our target markets - the US COPPA's under-13 line, the EU/UK GDPR's digital age of consent (Art. 8: 16 by default in the EU, 13 under UK law), and India's DPDP Act 2023 (Sec. 9: under-18, with its own parental-consent and no-targeted-advertising requirements) - so a single age rule keeps us clear of all of them. 3. Your account
You're responsible for keeping your account credentials and verified phone number secure, and for all activity that happens under your account. Tell us immediately at [email protected] if you suspect unauthorized use.
4. License to use HUMBL
We grant you a personal, non-exclusive, non-transferable, revocable license to use HUMBL for your own personal use, subject to these Terms. You may not: reverse-engineer, decompile, or extract the underlying models or source code; resell, sublicense, or provide the Service to third parties as your own product; use the Service to build a competing product; or use it for any unlawful purpose.
5. AI interaction and output
HUMBL uses AI (including third-party language and voice models) to generate spoken and written responses, including in its Think, Rant, Challenge, and Guide modes. These responses are AI-generated and may be inaccurate, incomplete, or inconsistent.
You're talking to an AI
This disclosure - which the EU AI Act (Art. 50) requires for AI systems that interact directly with people - is not a formality: HUMBL is an AI system end to end, not a human operator or a human-reviewed script.
Not professional advice
Nothing HUMBL says is medical, legal, financial, psychological, or other professional advice. Do not rely on it as a substitute for a qualified professional, especially in the Challenge and Rant modes, which are designed to push back and argue - not to give you correct or safe guidance.
Not a crisis service
HUMBL is not equipped to handle emergencies or mental-health crises. If you or someone else is in danger, contact local emergency services immediately.
Memory
HUMBL may remember facts you share across conversations to personalize future responses. You can view and delete this memory at any time in the app.
6. Your content, and AI training
You keep ownership of anything you say to HUMBL. We do not use your conversations, voice recordings, transcripts, or memory facts to train or improve any AI model - ours or a third-party provider's. Those AI providers process your voice/text to generate a response and, per our agreements with them, do not retain or train on it either (see Privacy Policy, Section 3).
We may use fully de-identified, aggregated usage statistics (e.g. how many sessions ran, average session length) to understand product performance - never the content of what you said.
7. Device permissions and connected services
Depending on what you enable, HUMBL may request access to your device's microphone, camera, location, Bluetooth, contacts, calendar, tasks, notifications, and secure storage; and may connect to third-party services including Google Calendar, Google Tasks, Spotify, Apple Music, WhatsApp, phone/SMS functions, and sign-in via Google or Apple.
Each of these is used only for the specific feature it powers (e.g. calendar access to read your schedule when you ask about it, contacts access to place a call you request). You control every one of these through your device's OS settings and can revoke any permission at any time; some HUMBL features will stop working if you do. See our Privacy Policy for what data each of these shares and why.
8. Third-party services
HUMBL depends on third-party services (cloud infrastructure, AI providers, calendar/music/messaging platforms, and others) to function. We don't control these services' uptime, accuracy, or behavior, and we're not responsible for their outages, changes, or failures. If a third-party service changes its terms, shuts down, or stops supporting an integration, the corresponding HUMBL feature may stop working without notice from us.
9. Changes we can make
Without notice
we may add, change, or remove features, connectors, or AI providers at any time, to keep the Service working, improve it, or respond to a third party's changes.
With notice
we will notify you (in-app or by the contact method you've provided) before any material change to these Terms, to our Privacy Policy, or to how we handle your personal data, and - where required by law - we will seek your renewed consent.
10. Termination
You can stop using HUMBL and delete your account at any time. We may suspend or terminate your access if you violate these Terms, misuse the Service, or if required by law. On account deletion, your data is handled as described in our Privacy Policy's retention section.
11. Disclaimers and limitation of liability
The Service is provided "as is" and "as available," without warranties of any kind. To the maximum extent permitted by law, QWR is not liable for indirect, incidental, or consequential damages arising from your use of the Service, including reliance on AI-generated content or the unavailability of any third-party-dependent feature.
"To the maximum extent permitted by law" is a real limit, not boilerplate: India's Consumer Protection Act 2019 renders certain waivers of a consumer's statutory rights unenforceable, and nothing in this section limits liability for fraud, gross negligence, or any right that cannot be excluded under that Act, GDPR/UK data protection law, or other applicable law in your jurisdiction.
12. Indemnification
You agree to indemnify and hold QWR harmless from any claim, loss, or expense (including reasonable legal fees) arising from your misuse of the Service, your violation of these Terms, or your violation of any third party's rights.
13. Compliance with authorities
We may disclose information to law enforcement or regulatory authorities where required by a valid legal process under applicable law - in India, this includes lawful interception/disclosure directions under the Information Technology Act, 2000 (Sec. 69) and requests under the Bharatiya Nagarik Suraksha Sanhita, 2023; equivalent frameworks apply in other jurisdictions (for example, the US CLOUD Act or the UK's Investigatory Powers Act 2016). We will notify you where legally permitted to do so.
14. Governing law
Governed by the laws of India, subject to the exclusive jurisdiction of the courts at Mumbai, Maharashtra - without prejudice to any rights you have under the GDPR, UK data protection law, the CCPA/CPRA, India's Consumer Protection Act 2019, or other applicable law in your jurisdiction.
15. Severability
If a court finds any provision of these Terms unenforceable (for example, under the limits described in Section 11), that provision will be limited or removed to the minimum extent necessary, and the rest of these Terms remain in full effect.
16. Assignment
We may assign these Terms, in whole or part, in connection with a merger, acquisition, or sale of assets. You may not assign or transfer your account or any rights under these Terms without our consent.
